Welcome to ARION Exquisite Jewelry. These Terms of Use (“Terms”) govern your access to and use of our website and your purchase of products through the Site. Please read them carefully. By accessing the Site or placing an order, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Site.
1. About Us
The Site is owned and operated by ARION JEWELRY, a business registered in Israel under company/dealer number 308099944, with its registered address at HABANIM 32, NORDIYA, Israel (“ARION”, “we”, “us”, or “our”). You can contact us at info@arion-jewelry.com or +972 54-465-2801.
2. Eligibility
You must be at least 18 years old and capable of entering into a legally binding contract to place an order through the Site. By using the Site, you represent that you meet these requirements.
3. Products, Descriptions and Materials
We make every effort to display and describe our jewelry as accurately as possible. However, please note:
- Many of our pieces are handcrafted. Minor variations in finish, texture, dimensions and weight are inherent to handmade jewelry and are not defects.
- Natural gemstones and pearls vary in color, clarity and inclusions. The item you receive may differ slightly from the photographs.
- Colors displayed on screen depend on your device settings and may not exactly match the physical product.
- Stated metal purity (e.g., 14K/18K gold, 925 sterling silver) and gemstone details are provided in good faith and, where applicable, supported by certificates from a certified gemologist from an external laboratory or a laboratory associated with the business.
We reserve the right to modify or discontinue any product at any time without notice.
4. Pricing, Currency and Taxes
Prices are displayed in US Dollars ($) and are subject to change without notice. Prices do not include shipping charges or any import duties, customs fees, VAT or other taxes imposed by the destination country, which are your sole responsibility (see Section 7). In the event of an obvious pricing error, we may cancel the affected order and issue a full refund, and we will notify you promptly.
5. Orders and Payment
Your order is an offer to purchase. A contract is formed only when we send you an order confirmation or ship the item, whichever is earlier. We may refuse or cancel any order at our reasonable discretion, including in cases of suspected fraud, pricing errors or stock unavailability; in such cases any amounts paid will be refunded in full.
Payments are processed by secure third-party payment providers: PayPlus and PayPal. We do not store your full payment card details. You represent that all information you provide is accurate and that you are authorized to use the payment method.
6. Custom and Personalized Orders
We offer made-to-order, engraved and custom-designed pieces (“Custom Items”). The following applies to Custom Items:
- A non-refundable deposit of 50% is required before production begins.
- Production timelines communicated to you are estimates and begin upon your final approval of the design and receipt of payment or deposit.
- You are responsible for confirming specifications you provide, including ring size, engraving text and design approvals. We are not responsible for errors in information supplied by you.
- Custom Items — including engraved items and items made to your specifications — are final sale and are not eligible for return, exchange or the 14-day return policy, except where the item is defective or materially different from the approved design. This exclusion is consistent with applicable consumer-protection laws, including the personalized-goods exception under EU law.
- One complimentary request for adjustment or ring resizing may be offered within 2 days of receiving the item where technically feasible; certain designs cannot be resized.
7. Shipping and Delivery
We ship worldwide from Israel using insured, tracked carriers. Delivery times shown at checkout are estimates only and are not guaranteed; delays caused by carriers or customs authorities are outside our control.
- International shipments may be subject to import duties, customs fees and local taxes levied by the destination country. These charges are your responsibility and are not included in the product price or shipping fee, unless expressly stated otherwise at checkout.
- A signature may be required upon delivery. Risk of loss or damage passes to you upon delivery to the address you provided.
- If a package is lost or arrives damaged, notify us within 3 days of receiving the package so we can process an insurance claim and arrange a replacement or refund.
- You are responsible for providing a complete and accurate shipping address. Packages returned to us due to an incorrect address or refusal to pay customs charges may incur re-shipping fees, and refused-shipment refunds may be reduced by outbound shipping and customs costs actually incurred.
8. Returns and Exchanges – 14-Day Policy
Returns are acceptable within 14 days of delivery. To return your item just email us at info@arion-jewelry.com within 14 days and mention you want to return your item. A shipping label will be provided, and a full refund will be issued minus return shipping costs once the item will arrive safely and inspected by our staff.
The package should be returned including all items that were received. Any use of any item in the package is forbidden for the return to take place. If an item (the jewel itself or any other item) was used in any way, the return request will be reviewed. ARION JEWELRY reserve the right to refuse the return request or, if acceptable, charge the client for any use of any product.
Please note that the following items are not eligible for return: Custom Items (Section 6); earrings, for hygiene reasons, unless defective; gift cards; and items marked “final sale”.
9. Consumers in the EU/EEA and the United Kingdom
If you are a consumer in the EU/EEA or the UK, you have a statutory right to withdraw from a distance purchase within 14 days of delivery without giving a reason. Our 14-day return policy (Section 8) aligns with this statutory right.
Under applicable law, the statutory right of withdrawal does not apply to goods made to your specifications or clearly personalized (e.g., engraved or custom-made jewelry). Nothing in these Terms limits your statutory rights regarding goods that are faulty or not as described, including your legal guarantee of conformity.
To exercise the statutory right of withdrawal, contact us at info@arion-jewelry.com with a clear statement of your decision, or use the model withdrawal form available on the Site.
10. United States Consumers
Nothing in these Terms limits any rights you may have under the laws of your state that cannot be waived by agreement, including applicable warranty and consumer-protection statutes. Any disclaimers and limitations in these Terms apply only to the maximum extent permitted by applicable law.
11. Warranty and Repairs
We warrant our jewelry against manufacturing defects for a period of 6 months from delivery. During this period we will, at our option, repair or replace a defective item free of charge, or refund it if repair or replacement is not feasible.
This warranty does not cover: normal wear and tear; damage caused by accident, misuse or improper care; loss of stones resulting from impact or wear; tarnishing of silver or plating wear, which are natural processes; or any item repaired, resized or altered by a third party. This warranty is in addition to, and does not limit, any statutory warranty rights you have under applicable law. Out-of-warranty repair services may be available for a fee — contact us for a quote.
12. Jewelry Care
Fine jewelry requires appropriate care. Please follow the care instructions provided with your item, including avoiding contact with chemicals, perfumes and water where relevant, and storing items appropriately. Damage resulting from failure to follow care instructions is not covered by our warranty.
13. Intellectual Property
All content on the Site — including text, images, photographs, logos, product designs, graphics and layout — is the property of ARION or its licensors and is protected by copyright, trademark and other intellectual-property laws. Our jewelry designs are original works. You may not copy, reproduce, distribute, create derivative works from, or commercially exploit any content or design without our prior written consent.
14. Acceptable Use
You agree to use the Site only for lawful purposes. You may not: interfere with the Site’s operation or security; use automated tools to scrape or harvest content or data; misrepresent your identity; upload malicious code; or infringe the rights of others. We may suspend or terminate access for violations of these Terms.
15. Privacy and Data Protection
Our collection and use of personal information is described in our Privacy Policy. Where required, we process personal data of EU/EEA and UK residents in accordance with the GDPR and UK GDPR, and honor applicable privacy rights of US residents (including under state privacy laws such as the CCPA/CPRA for California residents). Please review the Privacy Policy before using the Site.
16. Third-Party Links and Services
The Site may contain links to third-party websites or services (including payment providers and shipping carriers). We are not responsible for the content, policies or practices of third parties, and links do not imply endorsement.
17. Disclaimer
The Site and its content are provided on an “as is” and “as available” basis. While we strive for accuracy, we do not warrant that the Site will be uninterrupted, timely, secure or error-free, or that content (including product descriptions and availability) is complete or current at all times. This disclaimer applies to the Site itself and does not limit your rights in respect of products you purchase, including under Sections 8–11.
18. Limitation of Liability
To the maximum extent permitted by applicable law, ARION shall not be liable for indirect, incidental, special or consequential damages, or loss of profits or data, arising from your use of the Site. To the maximum extent permitted by applicable law, our total aggregate liability in connection with any order shall not exceed the amount you paid for that order.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or the mandatory consumer rights described in Sections 9 and 10.
19. Indemnification
You agree to indemnify and hold ARION harmless from claims, damages and expenses (including reasonable legal fees) arising from your breach of these Terms or your unlawful use of the Site. This section does not apply to consumers to the extent prohibited by applicable law.
20. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law principles. Subject to the paragraph below, the competent courts of Tel Aviv-Jaffa, Israel shall have exclusive jurisdiction over any dispute arising from these Terms or your use of the Site.
If you are a consumer residing in the EU/EEA, the UK or another jurisdiction whose laws grant you mandatory protections or the right to bring proceedings in your local courts, nothing in this section deprives you of those protections or that right.
21. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on the Site with a revised “Last updated” date, and material changes will be highlighted or notified where required by law. Changes apply prospectively; orders are governed by the Terms in effect at the time the order was placed.
22. General
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver. You may not assign your rights under these Terms without our consent; we may assign our rights to a successor of our business. We are not liable for delays or failures caused by events beyond our reasonable control (force majeure). These Terms, together with the Privacy Policy and any policies referenced herein, constitute the entire agreement between you and ARION regarding the Site.
